Thank you for visiting Hamper Co ("we", "us", "our"). These Terms & Conditions ("Terms") apply to your use of hampercompany.com.au and to all purchases you make from us. By accessing our website or placing an order, you agree to these Terms.
Use of the Website
1.1 You agree to use this website lawfully, respectfully and in accordance with Australian laws.
1.2 We may update or modify the website, including product information, at any time without notice.
1.3 We do not guarantee uninterrupted access to the website and are not responsible for temporary outages.
Products we sell
2.1 We offer a range of products including:

specially-made candles, bath salts, reed diffusers and room sprays

food items such as fudge, chocolate and flavoured popcorn

gift hampers containing our products

custom hampers that may include third-party foods (e.g., crackers, biscotti),

customer-supplied items (e.g., pens, business gifts, tea towels, etc.)
2.2 Product images and descriptions are provided as accurately as possible. Minor variations may occur in colour, packaging, scent strength, or appearance, especially for handmade items.
2.3 Where a product becomes unavailable, we may substitute it with a product of equal or greater quality and similar type.
Custom and personalised orders
3.1 Custom hampers may require additional production time depending on:

the complexity of the request

the availability of materials

seasonal order volumes (e.g., Christmas, Valentine’s Day)

staff availability
3.2 If you provide items to be included in a hamper, you are responsible for ensuring those items are safe, lawful, and do not violate intellectual property rights.
3.3 We are not responsible for damage to customer-supplied items unless such damage occurs due to our handling.
3.4 Personalised/custom items (e.g., printed coasters, engraved pots, custom candle jars) cannot be cancelled, returned or exchanged once production begins unless faulty.
Order processing times
4.1 Standard hamper assembly time is 2–3 business days.
4.2 Custom hamper orders may take longer.
4.3 During gifting seasons (e.g., Christmas, Mother’s Day, Valentine’s Day) or high-volume periods, processing times may increase.
4.4 We do not offer same-day delivery.
Payments
5.1 Payments are securely processed through Square.
5.2 By placing an order, you authorise Square to process the full payment amount.
5.3 We do not store credit card information. All sensitive data is handled by Square under PCI-DSS compliant systems.
5.4 Orders are not confirmed until payment has cleared.
Shipping & Delivery
6.1 We ship Australia-wide using Australia Post and other courier partners.
6.2 Estimated delivery timeframes:
Australia Post: typically 2–10 business days after dispatch (varies by location).
6.3 Delivery times may be affected by:

courier delays

public holidays
-
extreme weather events
-
seasonal postal congestion
6.4 Once a parcel is lodged with Australia Post or another courier, shipping progress is outside our control.
6.5 You are responsible for providing an accurate delivery address. If an order is returned due to an incorrect or incomplete address, redelivery fees will apply.
6.6 Risk of loss or damage passes to you at the moment the parcel is delivered to the supplied address.
Shipping & Delivery
7.1 We comply with the Australian Consumer Law (ACL). You are entitled to a refund, repair or replacement if your product is faulty, damaged, or not as described.
Faulty or defective products
7.2 If a product is defective or damaged, you may request a replacement or refund within 14 days of delivery.
7.3 Evidence such as photos may be required to assess the issue.
Change-of-mind exchanges
7.4 We offer exchanges for products you don’t like within 7 days of delivery.
7.5 Exchanges are for a product of similar value or for store credit.
7.6 Returned items must be unused, unopened and in resellable condition.
7.7 Return postage for change-of-mind exchanges is the customer’s responsibility.
Exceptions
7.8 We cannot accept returns or exchanges on:

personalised or custom-made items
-
customer-supplied items added to hampers
-
food items that have been opened
-
items damaged due to misuse or improper storage
Order cancellations
8.1 Orders may be cancelled before we begin assembling the hamper.
8.2 Once assembly has begun — or materials for custom/personalised items have been ordered — cancellation may not be possible.
8.3 If a cancellation is accepted, refunds will be issued back to the original payment method.
Alcohol (Good Will Wines)
9.1 Hampers containing alcohol can only be purchased by customers aged 18 years or over.
9.2 By ordering alcohol, you confirm that both you and the recipient are at least 18 years old.
9.3 Alcohol delivery restrictions vary by state, and couriers may require ID on delivery.
9.4 We comply with NSW liquor regulations. If verification cannot be completed, delivery may be refused.
Gift messages and special instructions
10.1 We will follow gift message instructions as closely as possible, but formatting or minor modifications may occur for clarity or safety.
10.2 If a requested message contains offensive or inappropriate content, we may refuse to include it.
Intellectual Property
11.1 All content on this website, including product designs, text, images, branding and graphics, is owned by or licensed to Hamper Co.
11.2 You may not reproduce or use our content without prior written permission.

Limitation of liability

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled exclusively by NSW courts or tribunals.
